These Terms of Use (“Terms”) govern your access to and use of the Sequim Irrigation Festival website, including any pages, online forms, and services made available through it (the “Site”). The Site is operated by the Sequim Irrigation Festival (“Festival,” “we,” “us,” or “our”).
We are 100% volunteer-run. We do our best to keep information accurate and respond quickly, but some responses and updates may take time due to volunteer availability.
By accessing or using the Site, submitting information through our online forms, or purchasing merchandise (when available), you agree to these Terms. If you do not agree, please do not use the Site.
1) Who We Are and What This Covers
These Terms apply to:
- Browsing and using the Site
- Submitting information through online registration or participation forms
- Downloads (including PDFs, applications, rules, and guidelines)
- Festival merchandise purchases made through the Site (when available)
- Any content you submit to us through the Site (including text, images, designs, or other materials)
2) Changes to the Site or Terms
We may update the Site and these Terms at any time. Changes take effect when posted. Your continued use of the Site after changes are posted means you accept the updated Terms.
3) Eligibility
You must be able to form a legally binding contract to use the Site. If you use the Site on behalf of an organization (for example, a business, club, or sponsor), you represent that you are authorized to accept these Terms on that organization’s behalf.
4) Privacy
Our collection and use of personal information is described in our

By using the Site, you agree that we may collect and use information as described there.
5) Online Forms, Registrations, and Submissions
When you submit a form (for example, vendor registration, parade participation, contests, volunteering, sponsorship interest, or other applications), you agree that:
- The information you provide is
accurate, current, and complete
- You will update your information if anything changes
- Form submission does
not guarantee acceptance
unless explicitly stated
- Deadlines, eligibility requirements, fees (if any), and additional rules may apply and are provided on the relevant event page, application packet, or form
- We may contact you using the information you provide (including email or phone) to confirm details, request additional information, or share updates related to your submission.
6) Event Information Disclaimer
We work hard to keep Festival information accurate, but details can change.
Festival schedules, locations, pricing, rules, deadlines, and availability are provided “as is” and may be updated due to weather, safety issues, staffing, venue needs, or other operational reasons. We are not responsible for losses caused by reliance on outdated, incomplete, or changed information.
7) Merchandise Purchases and Payments (Stripe)
If and when we sell merchandise (and/or accept other payments) through the Site, payments are processed by a third-party payment processor, currently Stripe (“Payment Processor”). The Festival does not receive or store your full payment card number.
By making a purchase, you authorize the Payment Processor to charge your selected payment method for the total amount shown at checkout, including any applicable taxes and fees. Your payment transaction may be subject to the Payment Processor’s terms, policies, and privacy practices in addition to these Terms.
We may correct pricing errors, limit quantities, discontinue items, or cancel/refuse orders in our discretion (including for suspected fraud, inventory issues, or mistakes).
Fulfillment, Returns, and Refunds:
Any shipping/pickup details and return/refund rules will be posted at checkout or on the merchandise page and are incorporated into these Terms.
7.1) Chargebacks and Disputed Payments
If you have a question about a charge, please contact us first so we can try to resolve it. If a payment is disputed through your bank or card issuer (a “chargeback”), we may request additional information to validate the transaction and/or pause fulfillment while the dispute is reviewed.
8) Third-Party Services and Links
The Site may include links or integrations to third-party services (for example, Stripe checkout, Google services, embedded maps, social media, or external registration platforms). We do not control those third-party sites or services and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.
9) Intellectual Property
Unless otherwise stated, the Site and its content—text, graphics, logos, photos, layouts, and downloadable materials—are owned by or licensed to the Festival and are protected by intellectual property laws.
You may view, download, and print materials for personal, non-commercial use related to Festival participation. You may not copy, reproduce, republish, modify, distribute, sell, or exploit Site content without our prior written permission.
10) User Content and Submission Rights
Some parts of the Site may allow you to submit content (for example: contest entries, designs, photos, descriptions, or other materials) (“User Content”).
By submitting User Content, you represent and warrant that:
- You own the content or have permission to submit it
- Your submission does not infringe anyone else’s rights (copyright, trademark, privacy, publicity, etc.)
- Your submission complies with any posted rules and guidelines
Permission to Use Submissions:
Unless a specific contest or event rule states otherwise, you grant the Festival a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, and distribute your User Content for Festival-related purposes, including promotion of the Festival (for example, on the Site, social media, press releases, and printed materials).
If you want limitations (for example, attribution preferences), include that in your submission notes when possible; we’ll make reasonable efforts but cannot guarantee placement in all contexts.
We may remove or decline User Content at any time.
11) Prohibited Uses
You agree not to:
- Use the Site for unlawful purposes
- Attempt to gain unauthorized access to the Site or its systems
- Interfere with the Site’s operation (including introducing malware, scraping, or automated excessive requests)
- Submit false information or impersonate others
- Use the Site to send spam or unsolicited communications
12) Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of harmful components.
13) Limitation of Liability
To the fullest extent permitted by law, the Festival (and its volunteers, directors, officers, contractors, and affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of (or inability to use) the Site.
14) Indemnification
You agree to defend, indemnify, and hold harmless the Festival (and its volunteers, directors, officers, contractors, and affiliates) from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Site
- Your violation of these Terms
- Your User Content or your submission of information through forms
- Your violation of any rights of another person or entity
15) Termination
We may suspend or terminate access to the Site (or parts of it) at any time if we believe you violated these Terms or if needed for operational or security reasons.
16) Nonprofit Organization
The Sequim Irrigation Festival is a nonprofit community organization. Use of the Site and participation in Festival activities are subject to these Terms and any event-specific rules posted on the Site.
17) Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict of laws principles.
You agree that any dispute arising out of or related to these Terms or the Site will be brought in the state or federal courts located in Washington State, and you consent to personal jurisdiction in those courts.
18) Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
